1. Introduction and Acceptance

Welcome to Makers Community Projects (hereinafter "the Application" ), a project management and workflow automation platform powered by Rukovoditel. The Application is owned and operated by Cadvision (hereinafter "we", "us", "our").

By accessing or using our Application, including any of its features, tools, or services, you acknowledge that you have read, understood, and agree to be bound by these Terms of Service (hereinafter "Terms" ). If you do not agree to these Terms, you are not permitted to use the Application .

These Terms apply to all users of the Application, including:

Free trial users
Paid subscribers
Account administrators
End users accessing data managed through the Application

2. Description of Service

Makers Community Projects is a cloud-based project management and business process automation platform built on the Rukovoditel framework. The Application allows users to:

Create and manage projects, tasks, and workflows
Collaborate with team members through comments and file sharing
Generate custom reports and dashboards
Manage data and entities according to their business needs
Integrate with third-party services, including Facebook Login

We reserve the right to modify, update, or discontinue any feature of the Application at any time, with reasonable notice to users when material changes occur .

3. User Eligibility and Account Registration

3.1 Eligibility

To use the Application, you must:

Be at least 18 years of age
Have the legal capacity to enter into binding contracts
Not be prohibited from using the service under applicable laws
Not be located in a jurisdiction where use of the Application would violate local laws

3.2 Account Registration

To access the Application, you must create an account. You agree to:

Provide accurate, current, and complete information during registration
Maintain and promptly update your information as needed
Keep your login credentials (username and password) confidential
Not share your account with others unless you have purchased multi-user subscriptions
Notify us immediately of any unauthorized use of your account

3.3 Account Responsibility

You are solely responsible for all activities that occur under your account. If you are creating an account on behalf of an organization, you represent that you have the authority to bind that organization to these Terms .

4. User Conduct and Prohibited Activities

4.1 Acceptable Use

You agree to use the Application only for its intended purpose—project management and business process automation—and in compliance with all applicable laws and regulations.

4.2 Prohibited Activities

You shall NOT use the Application to:

Upload, store, or transmit any illegal, defamatory, obscene, or harassing content
Infringe upon the intellectual property rights of any third party
Distribute malware, viruses, or other harmful code
Attempt to gain unauthorized access to the Application or its related systems
Interfere with or disrupt the integrity or performance of the Application
Use the Application for competitive analysis or to build competing products
Engage in any activity that violates the rights of others or harms the Application’s users

4.3 Content Responsibility

You retain ownership of all data, content, and materials you upload or create within the Application (hereinafter "Your Content"). However, you are solely responsible for the legality, accuracy, and appropriateness of Your Content. We reserve the right to remove any content that violates these Terms or applicable law .

5. Intellectual Property Rights

5.1 Our Ownership

All rights, title, and interest in and to the Application, including but not limited to:

Software code, architecture, and algorithms
Design, user interface, and visual elements
Trademarks, logos, and service marks
Documentation and related materials

are and shall remain the exclusive property of Cadvision or its licensors. The Application is protected by copyright, trademark, and other intellectual property laws .

5.2 Open Source Components

The Application is built on the Rukovoditel framework. While the underlying open-source software may be available under separate licensing terms, these Terms govern your use of our hosted cloud service. Your use of any open-source components is subject to their respective licenses .

5.3 User Content License

By submitting Your Content to the Application, you grant us a worldwide, non-exclusive, royalty-free license to host, store, display, and process Your Content solely for the purpose of providing the Application to you. You retain all ownership rights to Your Content .

6. Payments, Fees, and Subscriptions

6.1 Subscription Plans

The Application may be offered under various subscription plans, including a free tier with limited features and paid plans with additional functionality. We reserve the right to modify pricing or introduce new plans upon reasonable notice .

6.2 Billing and Payments

If you subscribe to a paid plan:

Fees are billed in advance on a monthly or annual basis, depending on your selected plan
Payment is due by the specified due date
Fees are non-refundable, except as required by law
You are responsible for providing accurate billing information

6.3 Subscription Changes

You may upgrade or downgrade your subscription at any time. Upgrades take effect immediately; downgrades take effect at the end of the current billing cycle. Refunds are not provided for downgrades .

6.4 Taxes

You are responsible for all taxes associated with your use of the Application, excluding taxes based on our net income.

7. Third-Party Services and Integrations

7.1 Facebook Login

The Application offers Facebook Login as an authentication option. By using Facebook Login, you acknowledge and agree that:

Your use of Facebook services is governed by Facebook’s own Terms of Service and Privacy Policy
We do not control Facebook’s data processing practices
You consent to sharing certain account information (such as your name and email address) with us through Facebook’s authentication service

7.2 Other Integrations

The Application may integrate with other third-party services. We do not endorse or assume responsibility for any third-party services, and your use of such services is at your own risk.

8. Data Protection and Privacy

9.2 Support

We provide technical support through jori.makinen@cadvision.fi during normal business hours. Support is available to all users, though response times may vary based on subscription tier.

10. Termination and Suspension

10.1 Termination by You

You may terminate your account at any time by:

Using the self-service account deletion feature in the Application (if available)
Contacting us at admin@cadvision.fi to request account closure

Upon termination, your right to use the Application ceases immediately. We will delete your data in accordance with our Data Removal Policy .

10.2 Termination by Us

We may suspend or terminate your access to the Application immediately, without notice, if:

You violate any provision of these Terms
Your use poses a security risk to the Application or other users
Required by law
You fail to pay fees when due

10.3 Data Upon Termination

Upon termination, we will make your data available for export for a period of 30 days, after which it will be permanently deleted from our active systems. Data may remain in encrypted backups for up to an additional 30 days .

11. Disclaimer of Warranties

THE APPLICATION IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO:

MERCHANTABILITY
FITNESS FOR A PARTICULAR PURPOSE
NON-INFRINGEMENT
ERROR-FREE OR UNINTERRUPTED OPERATION
SECURITY OR RELIABILITY OF THE APPLICATION

We do not warrant that the Application will meet your specific requirements or that any defects will be corrected .

12. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, Cadvision SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO:

Loss of profits, revenue, or data
Business interruption
Reputational harm
Unauthorized access to or alteration of your data

arising out of or related to your use of, or inability to use, the Application, even if we have been advised of the possibility of such damages.

Our total liability to you for any claims arising under these Terms shall not exceed the amount you paid us during the twelve (12) months preceding the claim .

13. Indemnification

You agree to indemnify, defend, and hold harmless Cadvision , its officers, directors, employees, and agents from and against any and all claims, damages, losses, liabilities, costs, and expenses (including reasonable legal fees) arising from:

Your use of the Application
Your violation of these Terms
Your violation of any third-party rights, including intellectual property rights
Your Content

14. Modifications to Terms

We reserve the right to modify these Terms at any time. If we make material changes, we will notify you by:

Posting the updated Terms on this page
Sending an email to the address associated with your account
Displaying a notice within the Application

Your continued use of the Application after the effective date of any changes constitutes acceptance of the modified Terms. If you do not agree to the changes, you must stop using the Application and terminate your account .

15. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of Finland , without regard to its conflict of law principles.

Any dispute arising out of or relating to these Terms or your use of the Application shall first be attempted to be resolved through informal negotiation. If the dispute cannot be resolved within 30 days, either party may submit the dispute to binding arbitration in Salo, Finland.

16. Miscellaneous

16.1 Entire Agreement

These Terms, together with our Privacy Policy and Data Removal Policy, constitute the entire agreement between you and Cadvision regarding the Application.

16.2 Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect .

16.3 No Waiver

Our failure to enforce any right or provision of these Terms shall not constitute a waiver of such right or provision.

16.4 Assignment

You may not assign or transfer these Terms without our prior written consent. We may assign or transfer these Terms without restriction .
